1. Service Description

BandBoost is an AI-powered NAPLAN practice platform operated by Aria Infotech Pty Ltd (“we”, “us”, “BandBoost”). The platform provides NAPLAN-style practice tests for Australian students in Years 3, 5, 7, and 9 across Literacy, Numeracy, Conventions, and Writing, with AI-generated feedback after each test and progress reports for parents.

BandBoost is an independent practice platform and is not affiliated with, endorsed by, or connected to ACARA (the Australian Curriculum, Assessment and Reporting Authority). Practice questions are written by BandBoost's education team and are not official NAPLAN questions.

2. Eligibility

You must be 18 years of age or older to create a BandBoost account. BandBoost accounts are for parents and guardians who register on behalf of their children. Students (minors) do not create accounts directly and do not have their own login credentials.

By creating an account, you confirm that you are the parent or legal guardian of any students you register, and that you have the authority to consent to the collection and processing of their educational data as described in our Privacy Policy.

3. Account Responsibilities

You are responsible for maintaining the security of your account credentials. Do not share your password with others. You are responsible for all activity that occurs under your account.

4. Payment Terms

Pricing

Each subject (Literacy, Numeracy, Conventions, or Writing) costs AUD $19.99 and includes 10 full practice tests. The full bundle (all 4 subjects) costs AUD $59.99. All prices are in Australian dollars and include GST.

Aria Infotech Pty Ltd, ABN [TBD], is registered for GST. A tax invoice is issued automatically upon payment.

Access Expiry

Access to purchased subjects is valid for 12 months from the date of purchase. After 12 months, access expires and practice tests can no longer be taken. Your child's results and AI feedback reports remain accessible permanently after expiry. The expiry date for each subject is displayed on your dashboard.

Refund Policy

We offer a full refund within 7 days of purchase if no tests have been completed. After 7 days, or after any test is started, refunds are not available. To request a refund, email [email protected] with your order details.

Nothing in this refund policy limits or excludes any guarantee, condition, warranty, right, or remedy which you may have under the Australian Consumer Law which cannot be limited or excluded.

5. Acceptable Use

You agree not to:

• Reverse engineer, copy, or reproduce any part of the BandBoost platform or its content
• Scrape, crawl, or systematically download practice questions or AI feedback
• Share your account credentials or allow others to access your account
• Attempt to circumvent any security measures on the platform
• Use the platform for any commercial purpose without written consent
• Misrepresent your identity or relationship to any student you register

6. Intellectual Property

All practice questions, AI feedback templates, design elements, and content on BandBoost are the intellectual property of Aria Infotech Pty Ltd. You are granted a limited, non-transferable licence to use the platform for personal, non-commercial use by your registered students during your access period.

7. Privacy

Your use of BandBoost is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains what data we collect, how we use it, and your rights under the Australian Privacy Act 1988.

8. Disclaimer and Limitation of Liability

BandBoost is a practice tool designed to help students prepare for NAPLAN. We do not guarantee any specific improvement in NAPLAN results. AI feedback is generated automatically and may occasionally contain errors. Practice questions are designed by our education team and are not official NAPLAN questions.

To the maximum extent permitted by law, Aria Infotech Pty Ltd is not liable for any indirect, incidental, special, or consequential loss arising from your use of the platform. Our total liability to you is limited to the amount you paid for your current access period.

Nothing in these Terms excludes any right or remedy you may have under the Australian Consumer Law.

9. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the courts of Queensland.

10. Changes to These Terms

We will notify you by email at least 30 days before making material changes to these Terms. Your continued use of BandBoost after the effective date of changes constitutes acceptance of the updated Terms.
